JobRhino Terms of Service

JobRhino Terms of Service These terms are the agreement between JobRhino LLC ("JobRhino", "we", "us") and the company that uses JobRhino ("your company", "you"). They apply to everyone who signs in for your company. Your company's Owner accepts them for the company. Two more policies are part of these terms: - Acceptable Use Policy: https://app.jobrhino.pro/policies/acceptable_use - Privacy Policy: https://app.jobrhino.pro/policies/privacy 1. What JobRhino is JobRhino is software for contractor companies. It keeps your customers, proposals, jobs, schedule, invoices and payments in one place. It sends your company's email and texts, and it has an assistant that helps you write. JobRhino is a tool. It does not do your company's work, and it is not your lawyer, accountant or bank. 2. Who may use JobRhino JobRhino is for businesses in the United States. It is not for personal or household use. There is no sign-up page: JobRhino sets up each company's account and invites its Owner. The person who accepts these terms must be at least 18 and allowed to accept them for the company. 3. Your team and sign-ins - Your company's Owner is responsible for the team: who gets a sign-in, what each person's role lets them do, and what they do in JobRhino. Your Owner or an Admin adds and removes people. - Each sign-in is for one person. Do not share a sign-in, a password or a sign-in code. - Each person can turn on two-step sign-in. We recommend it. - When someone leaves, remove their access. Their work stays with your company. - If you think someone else got into an account, tell your Owner and write to chase@jobrhino.pro right away. 4. Plans and prices JobRhino prepares your company's plan. Its price and what it includes are shown on Settings > JobRhino Billing before you pay. Today's standard plans, in US dollars, are: - JobRhino Pro: $149 a month or $1,490 a year. 5 staff users and 1 trade pack. - JobRhino Team: $349 a month or $3,490 a year. 10 staff users and 1 trade pack. - JobRhino Scale: $599 a month or $5,990 a year. 20 staff users and 1 trade pack. - Each extra staff user: $59 a month or $590 a year. - Each extra trade pack: $99 a month or $990 a year. - JobRhino Custom: priced by written quote. Everyone with a JobRhino sign-in counts as a staff user, the Owner included. Your customers do not count. To change your plan or add staff users, write to chase@jobrhino.pro. There is no setup fee on a standard plan. Setup work for a Custom plan is quoted separately. Prices do not include taxes. Where tax applies, it is added to your bill. Your company keeps the price it accepted. If JobRhino changes it, we will tell your Owner at least 30 days before the renewal it applies to. 5. Paying JobRhino - Stripe handles your company's JobRhino bill. Your Owner or an Admin pays on Stripe's secure page and can update the payment method from the Billing page. - A monthly plan is paid at the start of each month. A yearly plan is paid at the start of each year and costs the same as ten monthly payments. - Your plan renews by itself each month or year until it is cancelled. - If a payment fails, Stripe may try it again. For 7 days, JobRhino keeps working as usual. After that, your team can still sign in, see your records, download them and pay the bill. But no one can make changes, and your customers cannot pay your invoices online through JobRhino. This lasts until the bill is paid. - If the bill is still unpaid after 30 days, or Stripe ends your plan after its tries, your plan is suspended. JobRhino does not delete your company's records because a payment failed. 6. Cancelling - Your Owner or an Admin can cancel on Settings > JobRhino Billing. - Cancelling stops the next renewal. Your company keeps full use of JobRhino through the month or year already paid for. - After that, your team can still sign in, see your records and download them, but cannot make changes. Your records are not deleted unless your company's account is closed (section 10). To start again, write to chase@jobrhino.pro. - JobRhino does not refund time already paid for, including the rest of a month or year, unless the law requires it. - Cancelling JobRhino does not cancel or refund payments your company collected from its own customers. 7. Texting charges Texting is an optional add-on. It is not included in your plan price. - Texting costs $10 a month. Your company pays the first $10 before texting is set up. On a monthly plan, texting is a separate line on the same bill. On a yearly plan, texting is still billed each month. - JobRhino sends your company's texts through Twilio. Each month, the $10 covers the first $5 of what Twilio charges for your company's texting. For anything above $5, JobRhino bills what Twilio charges plus 50%. Twilio's charges include each text sent and received, phone company fees, your phone number, and texting sign-up fees. - Tax that Twilio charges on your company's texting is passed on to you at cost, with nothing added. - JobRhino bills these charges after the month ends. - JobRhino does not limit, hold or stop your texting because of cost. You pay for all texting your company causes, including charges that arrive after you turn texting off or cancel. - Any cost figure JobRhino shows you is an estimate, not a limit or a promise. - Before your company can text, the phone companies must approve your company's texting sign-up. JobRhino cannot promise that they will, or how long it will take. - Text only people who said yes to your texts, and stop when they ask. The Acceptable Use Policy says more. 8. Customer payments Customer payments. If your company accepts card payments from your customers through JobRhino, Stripe processes those payments and pays them into your company's own Stripe account. Your company's Stripe account is governed by your company's agreement with Stripe. Your company is the seller your customer pays, also called the merchant of record. JobRhino does not receive, hold or pass along your customers' money, and JobRhino adds no fee to these payments. Stripe charges its own processing fees. Your company decides on and makes any refund, from its Stripe account. If a customer disputes a payment with their card company, your company is responsible for answering the dispute, for any amount the card company takes back, and for Stripe's dispute fee. JobRhino tells your company's Owner and Admin when Stripe reports a refund or a dispute, and can gather your JobRhino records into one file, but JobRhino does not answer disputes for you and does not promise any outcome. 9. Your company's information - Your company owns what it puts into JobRhino: its customers, records, photos, files and messages. - You let JobRhino store, copy, show and send that information only to run JobRhino for your company, to keep it working and safe, and as the Privacy Policy says. JobRhino does not sell it. - JobRhino staff may open your company's records to help you, to fix a problem, or to keep JobRhino safe. - Your company must have the right to put each piece of information into JobRhino, and the right to contact each customer the way it does. - While your company uses JobRhino, your Owner, Admins and Office staff can download a copy of your company's records and files at https://app.jobrhino.pro/account/data - Upload only photos, documents, logos and other material your company owns or has permission to use. If someone tells us that something in JobRhino copies their work without permission, we may remove it or block access to it while we look into it, and we will tell your Owner. If you think we removed something by mistake, write to chase@jobrhino.pro and we will look at it again. We end the account of a company or person that keeps uploading other people's work without permission. - To report that something in JobRhino copies your work, write to chase@jobrhino.pro with: your name, address, phone and email; the work you own; where the copy appears, for example the link you were sent; a statement that you believe in good faith that the use is not allowed by you, your agent or the law; a statement that your notice is accurate and, under penalty of perjury, that you own the work or may act for its owner; and your signature (a typed name is fine). 10. Closing your account - Your company's account closes when its only Owner deletes their account in the JobRhino phone app (Account, then Delete my account). Your Owner can also ask by writing to chase@jobrhino.pro. - When your account closes, your plan ends at the end of the month or year already paid for, with no refund, and your texting stops. Final texting charges may still come. - For 30 days after your account closes, your Owner can sign in on the web and download your company's records. - After 90 days, JobRhino deletes or makes anonymous your company's ordinary records, as the Privacy Policy says. JobRhino keeps the records the Privacy Policy lists, such as billing, tax, security and signing records, and anything the law says to keep. 11. The assistant - JobRhino's assistant, Rhino, drafts words and suggests next steps. It can look up records that the person using it is allowed to open. - When calendar assistance is available and connected, Rhino can monitor busy times on the calendars your company chooses. The person connecting must have the right to share that information and must authorize the connection. Ordinary calendar sync does not automatically turn on calendar assistance. - A person with the right access can ask Rhino to carry out a supported change to a JobRhino appointment. A clear request gives permission for that change without always needing a second confirmation. Rhino asks for missing details or a separate decision when needed. Monitoring does not authorize Rhino to move or remove events on its own. Customer messages and other actions keep the review steps shown in JobRhino. - If your company turns on the Friday digest email, the assistant helps lay out that email to your team each week. - The assistant can be wrong. Your company is responsible for what it sends and saves. - Your plan includes a monthly amount of assistant use, shown on Settings > JobRhino AI. When it runs out, the assistant stops until the next month, unless your Owner or an Admin buys more. $15 adds $10 of assistant use. JobRhino never buys more for you. 12. Your documents and legal duties stay yours - JobRhino has no state or local rules built in. It does not give legal, tax or accounting advice. - Your proposals, agreements, prices, warranties, notices and messages are your company's. Your company decides what they say and is responsible for them. - If your work needs a form or notice, such as a right to cancel, your company adds its own form in Settings > Agreements. JobRhino does not check that a form, a signature or a notice is enough under the law. Have your own lawyer review your forms. - Sample content JobRhino gives you, such as service lists, prices, pictures, proposal wording and presentations, is a starting point. Check it before you use it. - Your company is responsible for its licenses, its work, its customers, and following the laws that apply to it. 13. Other companies JobRhino works with JobRhino uses other companies to run parts of the service, such as Stripe, Twilio, Resend and OpenAI. The Privacy Policy lists them. If one of them is down or changes its rules, part of JobRhino may not work for a while. Your company's own accounts with them, such as your Stripe account or a calendar you connect, follow your agreements with those companies. 14. Help and support - For help, write to chase@jobrhino.pro. - We offer each new company a guided kickoff call to help set up JobRhino. It is not required. - We work first on problems that stop your company from working: JobRhino being down, security problems, and payment or sign-in problems. - JobRhino does not promise that it will always be available, or that we will answer within a set time. - Support does not include unlimited custom work or business advice. 15. Changes to JobRhino and to these terms - We change and improve JobRhino over time. We may add, change or remove features. - When we change these terms, we publish a new version at https://app.jobrhino.pro/policies/terms with its date and version number. Your company's Owner is asked to accept it in JobRhino. Your company keeps working while they do. - A new version applies from the day it is published. If your company does not agree to it, your Owner can cancel. If your company keeps using JobRhino, the new version applies. 16. Pausing or ending an account - JobRhino may pause a person's sign-in, a feature such as texting, or your company's account. We do this to stop harm, to protect other companies or customers, or when the law requires it. We will tell your company's Owner why. - Serious or repeated breaks of these terms or the Acceptable Use Policy can end your company's account. - If JobRhino stops offering the service, we will tell your Owner at least 30 days ahead, so your company can download its records. - When an account ends, your company's information is handled the way section 10 and the Privacy Policy say. Money owed before the end is still owed. 17. What JobRhino does not promise We work hard to keep JobRhino running and correct. But JobRhino is offered "as is" and "as available". We do not promise that it will always work, be free of mistakes, keep every file forever, win your company work, or fit your business's needs. To the extent the law allows, JobRhino makes no other promises, written or implied. 18. Limits on what JobRhino owes - To the extent the law allows, JobRhino is not responsible for lost profits, lost jobs, lost data, or any indirect or special losses. - To the extent the law allows, the most JobRhino owes your company for all claims together is what your company paid JobRhino in the 12 months before the claim. - Some claims come from your company's own work, documents or messages, or from breaking the law or these terms. Your company is responsible for those claims and will cover JobRhino's costs from them. 19. Disputes and the law that applies - If there is a problem, write to chase@jobrhino.pro first. We will try to work it out with you within 30 days. - Missouri law governs these terms. Any court case about them will be in the state or federal courts in Missouri. 20. Other terms - These terms, the Acceptable Use Policy, the Privacy Policy and the plan your company accepted are the whole agreement between your company and JobRhino. - If part of these terms cannot be enforced, the rest still applies. - If JobRhino does not enforce part of these terms right away, it can still enforce it later. - Your company may not hand these terms to another company without our written OK. JobRhino may hand them to a company that buys JobRhino's business. - We may use ideas or suggestions you send us to improve JobRhino, without owing you anything. - Accepting these terms in JobRhino counts as signing them. 21.
